AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) an nft  (“Company“, “we”, “us”, or “our”), concerning your access to and use of the https://an-nft.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Please note that we may update these Terms of Use from time to time. When we do, we’ll change the date below. By continuing to use this Site after those changes become effective, you agree to be bound by those changes, whether or not you have reviewed them.

We do not intend for the information on our Site to be available to or used by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. an-nft.com respects the intellectual property rights of others. Per the DMCA, an-nft.com will respond expeditiously to claims of copyright infringement on the Site if submitted to an-nft.com Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, an-nft.com will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content.

If you believe that your intellectual property rights have been violated by an-nft.com or by a third party who has uploaded materials to our website, please provide the following information to the designated Copyright Agent listed below:

A description of the copyrighted work or other intellectual property that you claim has been infringed;
A description of where the material that you claim is infringing is located on the Site;

In the event an-nft.com removes the allegedly infringing materials, an-nft.com will immediately notify the person responsible for posting such materials that an-nft.com or disabled access to the materials. an-nft.com may also provide the responsible person with your email address so that the person may respond to your allegations.

USER REPRESENTATIONS

If you use the Site, you represent and warrant: (1) that you are at least 13 years old; (2) that you have the legal capacity to enter into this agreement and comply with its terms; (3) that you are not a minor in your state or country; (4) that you will not access the Site through automated means or non-human means; (5) that your use of the Site will not violate any applicable laws or regulations; and (6) that if there is a dispute about or involving the site, you shall indemnify, defend and hold harmless  HITB Conferences.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

PROHIBITED ACTIVITIES

You may not use the Site for any purpose other than that for which we make it available. We do not endorse or approve commercial endeavors undertaken by users of the Site.

  15. 15. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you.
  16. 16. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.
  17. 17. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  18. 18. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
  19. 19. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
  20. 20. Use a buying agent or purchasing agent to make purchases on the Site.
  21. 21. Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

USER GENERATED CONTRIBUTIONS

 The Site invites you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality. The Site may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site. This includes but is not limited to text (including discussions about topics we’re covering in class), writings (including stories and poems), video (recorded talks and performances), audio (intonations of your voice), photographs (images that you’ve shot), graphics (illustrations and cartoons), comments (reactions to news articles or blog posts), suggestions (ideas for stories), personal information or other material.

  1.  The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
    2.  You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.
    3.  You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.
    4.  Your Contributions are not false, inaccurate, or misleading.
    5.  Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
    6.  Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
    7.  Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
    8.  Your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another.
    9.  Your Contributions do not violate any applicable law, regulation, or rule.
    10.  Your Contributions do not violate the privacy or publicity rights of any third party.
    11.  Your Contributions do not contain any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.
    12.  Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors;
    13.  Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
    14.  Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.

Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.

CONTRIBUTION LICENSE

 When you post your Contributions to this Site, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid worldwide license to host, use, copy, reproduce and sell your Contributions. We can use and distribute your Contributions (including, without limitation, your image, voice and name) for any purpose. We may prepare derivative works of your Contribution or incorporate it into other works, and we may grant sublicenses for any of the foregoing. The use and distribution may occur in any media formats and through any media channels.

 This license applies to any form of media now known or hereafter developed, including but not limited to print, digital, broadcast, and all other forms of distribution. It also includes our use of your name and any other personal information you provide, as well as any trademarks, service marks, trade names and logos, and personal and commercial images you provide. You waive any moral rights in your Contributions, and warrant that moral rights have not otherwise been asserted in your Contributions.

 You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site. You are solely responsible for your Contributions to the Site, so please use caution and common sense when posting information about yourself or others.

We reserve the right to edit, redact, or otherwise change any Contributions. We also reserve the right to re-categorize any Contributions to place them in more appropriate locations on our Site. We don’t have to pre-screen or delete your Contributions before posting, but we may do so at any time and for any reason.

If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid or unenforceable for any reason, such provision will be removed from the Terms of Use without affecting the remaining provisions of the Terms of Use, which will continue to be in full force and effect. These Terms of Use were written in English (US). To the extent any translated version of these Terms of Use conflict with the English version, the English version controls.
